These terms cover the Arty Digital website and agency services. For the Arty Studio desktop software, see the Arty Studio License Agreement (EULA).
1. Parties
These Terms of Service are entered into between ARTUN CINGÖZ, acting on behalf of Arty Digital Yazılım ve Bilişim Teknolojileri (Tax No: Etimesgut V.D. / 2111201431, Address: Yeni Bağlıca Mah. Etimesgut / Ankara, Turkey — hereinafter "Service Provider"), and the natural or legal person using the website or requesting services (hereinafter "User").
2. Scope of Service
Arty Digital Yazılım ve Bilişim Teknolojileri provides mobile app development, website design, AI video production, UGC avatar content creation, business automation, and digital consulting services. Specific project scopes are defined in separate agreements. Additional requests not specified in the agreement are subject to separate evaluation.
3. Intellectual Property
Unless otherwise stated, all code, designs, visuals, logos, and materials produced until project delivery remain the property of Arty Digital Yazılım ve Bilişim Teknolojileri. Upon completion of delivery and payment, rights specified in the agreement are transferred to the client. Third-party licenses and open-source code are subject to their own license terms. All content on this website belongs to Arty Digital and may not be copied or used without permission.
4. Payment Terms
Payments follow the schedule agreed upon at project start. Standard payment plan: 40% upfront, 30% mid-delivery, 30% final delivery. Legal interest may apply to late payments. Work on projects with unpaid invoices may be suspended.
5. Cancellation and Refunds
Refunds for started projects are subject to deduction of labor costs and expenses incurred. For project cancellations, costs for completed work will be collected. Projects may be suspended or scope modified by mutual agreement.
6. Limitation of Liability
Arty Digital is not liable for issues arising from third-party services (e.g., hosting outages, Google API changes, payment infrastructure issues). Issues arising from client modifications to delivered products are also outside the scope of responsibility.
7. Dispute Resolution & Jurisdiction
Ankara Courts and Enforcement Offices have exclusive jurisdiction for any disputes arising from these Terms. Turkish Law applies. The parties agree to first seek resolution through good-faith negotiation.
