Buy Arty Studio

This form informs the Buyer before the distance sales agreement is concluded, under article 5 of the Turkish Distance Contracts Regulation (based on Consumer Protection Law No. 6502). At checkout you see it filled in with the details you enter and the plan you choose, and you read and accept it before paying. The accepted text is emailed to you with your order confirmation. This is a translation; if the Turkish and English versions differ, the Turkish text (artydigital.com.tr/tr/arty-studio/on-bilgilendirme-formu) prevails, without limiting any mandatory consumer rights you have in your own country.

3. Main characteristics of the product

Arty Studio is desktop software for macOS (Apple Silicon and Intel) and Windows (64-bit) that brings video, image and audio generation into one window. What you buy is a license to use the software under its End User License Agreement ("EULA", artydigital.com.tr/arty-studio/eula); ownership of the software or its source code is not transferred.

• Plan: Yearly subscription
• Every plan unlocks every module and includes commercial use. A license can be active on up to 2 devices at a time and is personal.
• Updates: all updates while a subscription runs; every 1.x update with a lifetime license.
• Generation costs are not included. The AI features run on API keys for third-party services that the Buyer gets with their own account (such as fal.ai, Higgsfield, Google Gemini, OpenAI, Anthropic, ElevenLabs). Those services are paid directly, at their own prices; the Seller does not resell them or take a commission.

4. Functionality and compatibility of the digital content

• System: a macOS computer (Apple Silicon or Intel) or a 64-bit (x64) Windows computer.
• Internet: generating needs a connection to the chosen services. The license is checked online about once a day; without a connection the software keeps working for 7 days.
• Technical protection: a license key and a device limit. The software keeps generations, projects and API keys (encrypted) only on the Buyer's computer.

5. Price and payment

Prices are in US dollars (USD); 20% VAT is added. Total including taxes:

• Yearly subscription: $119.00 + 20% VAT $23.80 = $142.80 (every year)

• There are no delivery or other extra charges.
• Payment is by credit or debit card through iyzi Ödeme ve Elektronik Para Hizmetleri A.Ş. ("iyzico"), a payment institution licensed by Türkiye's banking regulator (BDDK), with 3D Secure. You enter your card on iyzico's secure payment page; it never reaches the Seller.
• If your card is in another currency, your bank converts it; the bank's rate and fees are outside the Seller's control.
• Monthly and yearly subscriptions charge the same amount at the start of each period to the card stored with iyzico. If a subscription price changes, the new price is announced by email at least 30 days ahead and applies from the first renewal after the notice.

6. Delivery

There is no physical delivery. Once payment is confirmed, the license key and download link are emailed to the address the Buyer gave at checkout. Delivery happens right after payment; if something goes wrong technically, it is completed within 24 hours at the latest. The legal maximum is 30 days.

7. Term and termination

• Monthly and yearly subscriptions: Open-ended and renew automatically each period. The Buyer can cancel at any time by writing to info@artydigital.com.tr or through the link in the order email; cancellation takes effect at the end of the paid period, and the software stays unlocked until then.
• Lifetime license: One payment; the right to use the 1.x major version indefinitely. A future major version (e.g. 2.0) may be charged separately.

8. Right of withdrawal

The license key is delivered electronically right after payment. Under article 15/1-(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly online or to intangible goods delivered to the consumer instantly. By agreeing at checkout that delivery starts immediately, the Buyer accepts that there is therefore no statutory right of withdrawal. For consumers in the European Union, starting delivery of digital content with express consent likewise ends the right of withdrawal.

9. Voluntary refund

Although there is no statutory right of withdrawal, the Seller voluntarily offers this refund: a full refund within 14 days of the first purchase (the first subscription payment or a lifetime license), no reason needed. Ask by writing to info@artydigital.com.tr with your order number; the refund goes back to the card you paid with, through iyzico, and can take a few business days to arrive depending on your bank. 10. Complaints

Send complaints first to info@artydigital.com.tr, +90 530 230 80 40 or the postal address above; we reply within 30 days at the latest. For disputes, consumers in Türkiye can apply to the Consumer Arbitration Committee where they live or where the purchase was made, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Courts above those limits. If you live in another country, its mandatory consumer-protection rules are unaffected.

11. Personal data and records

The personal data you give with your order is processed under the Personal Data Notice (artydigital.com.tr/arty-studio/personal-data-notice). The Seller keeps this form and the distance sales agreement for at least 3 years and emails them to you as accepted.

2. Subject

This agreement sets out the rights and obligations of the parties, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, for the sale and delivery of the Arty Studio software license described below, ordered electronically by the Buyer on the Seller's website. The Buyer confirms having read and accepted the Pre-Contractual Information Form (artydigital.com.tr/arty-studio/pre-information) before accepting this agreement; the form is an integral part of it.

3. Product

The AI features run on API keys for third-party services that the Buyer gets with their own account; those services are not included in the price and are paid directly to them.

2. For monthly and yearly subscriptions, the Buyer authorises the same amount to be charged at the start of each period to the card stored with iyzico. If a subscription price changes, the new price is announced by email at least 30 days ahead and applies from the first renewal after the notice; if the Buyer doesn't accept it, they can cancel before the renewal.
3. No delivery or other extra charges apply. If the card is in another currency, the bank converts it; the bank's rate and fees are not the Seller's responsibility.
4. The invoice is issued with the details the Buyer gave at checkout and emailed to them.

5. Delivery

1. The product is delivered electronically; there is no physical delivery.
2. Once payment is confirmed, the license key and download link are emailed to the Buyer. Delivery happens right after payment; if something goes wrong technically, it is completed within 24 hours and never later than the legal 30 days.
3. The Seller is not responsible for delays caused by a wrong or incomplete email address; the Buyer can ask for it to be re-sent by writing to info@artydigital.com.tr.

6. Subscription term, renewal and cancellation

1. Monthly and yearly subscriptions are open-ended and renew automatically each period.
2. The Buyer can cancel at any time by writing to info@artydigital.com.tr or through the link in the order email. Cancellation takes effect at the end of the paid period; the software stays unlocked until then and no further charges are made.
3. If a renewal payment fails or the subscription ends, the license ends and the software locks; the generations and data on the Buyer's computer are not deleted.
4. A lifetime license is one payment and gives the right to use the 1.x major version indefinitely.

7. Right of withdrawal

The product is an intangible good delivered electronically right after payment. Under article 15/1-(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly online or to intangible goods delivered to the consumer instantly. By expressly agreeing at checkout that delivery starts immediately, the Buyer accepts that there is no right of withdrawal.

8. Voluntary refund

The Seller offers, beyond what the law requires, a full refund within 14 days of the first purchase (the first subscription payment or a lifetime license), no reason needed. Ask by writing to info@artydigital.com.tr with your order number; the Seller refunds the card used for payment through iyzico within 14 days at the latest. How long the money takes to arrive depends on your bank. Renewal payments are not refunded. The license key of a refunded purchase is disabled.

9. Obligations of the parties

1. The Seller delivers the product free of defects and as described in this agreement and the Pre-Contractual Information Form. If the product is defective, the Buyer's rights under Law No. 6502 are unaffected.
2. The Buyer declares that the details given at checkout are correct, that they are at least 18, and, if buying for a company, that they are authorised to bind it.
3. The Buyer agrees to use the software under the EULA, not to share the license key and to follow the terms of the third-party services.
4. If a payment is wrongfully reversed by the cardholder or their bank (chargeback), the Seller may suspend the license concerned.

10. Personal data

The Buyer's personal data is processed under the Personal Data Notice (artydigital.com.tr/arty-studio/personal-data-notice) to conclude and perform the order, to invoice and to meet legal obligations. Card data is processed only by iyzico.

11. Disputes

This agreement is governed by the laws of the Republic of Türkiye. Consumers can apply to the Consumer Arbitration Committee where they live or where the purchase was made, within the monetary limits announced each year by the Ministry of Trade, and to the Consumer Courts above those limits. For buyers acting as merchants, the Ankara (Central) Courts and Enforcement Offices have jurisdiction.

12. Entry into force

The agreement is concluded when the Buyer accepts it and the Pre-Contractual Information Form at checkout and completes the payment. The Seller emails the accepted agreement and form to the Buyer on a durable medium and keeps them for at least 3 years. This agreement has 12 sections.
